Debunking Mediation Myths

Couples who wish to end their marriage in amicably and quickly tend to utilize the services of a mediator who can help them through the process. Mediation is a good alternative for couples who agree to the terms of their divorce and want to terminate their marriage in a way that is cost effective. If you’re contemplating the idea of mediation and don’t know if it’s a good option for you and your spouse, it’s important to not fall for the myths surrounding mediation.

Myth #1: One Spouse Dominates the Other

During mediation, it’s your mediator’s job to pay attention to the power balance that exists between you and your spouse. If it becomes apparent that there is an imbalance and one spouse is taking advantage of the other with unnecessary dominant behavior, the mediator should suggest that everyone take a break to collect their thoughts before resuming. You should also be vocal about your concerns during mediation.

Myth #2: Women are Put at a Disadvantage

Stigmas surrounding mediation purport that women receive the “short end of the stick” during the process – this myth couldn’t be further from the truth. Oftentimes, women find themselves securing more favorable outcomes. Because of the opportunity it gives spouses to voice their opinions, both parties are able to equally negotiate agreements.

Myth #3: Mediation Makes the Process Longer

Unlike traditional divorce proceedings and litigation, mediation gives divorcing spouses control. For this reason, you’ll be able to identify the issues you want to address and circumvent getting caught up in time-consuming arguments and disagreements.

Our Illinois mediation attorneys have experience resolving divorces through negotiations and collaborations. If you’re struggling with issues pertaining to child support, child custody, alimony, or property division, Wakenight & Associates, P.C. is here to help.
