Assistance to Police & Prosecutors

An order of protection does not prevent or stop any physical act, and should in no way embolden the protected party into thinking that he or she is fully protected. An order of protection tells the police how to act when they arrive on the scene and gives the prosecutor grounds to file additional charges against the offending party, should he or she violate the court order.

Criminal & Civil Order of Protection

If a criminal charge of domestic battery is filed, a criminal petition for order of protection is often also filed. If the criminal charge is dropped, the petition will also be dropped. These are generally used in extreme cases when violence or the threat of violence is severe.

Civil petitions for orders of protection can be filed separately or as part of another proceeding, such as in a divorce.

In either case, an order of protection cannot be used for improper means such as securing custody or using false accusations against another your spouse or other family member.
