Appeals
Mistakes of Law or Fact - Judges make mistakes. They misapply the law or they fail to properly consider and evaluate the evidence before them.
Evidentiary Issues – When it comes to the admission of evidence, Family Law Judges routinely error on the side of admitting additional evidence. Since there are no juries in family law, the court can allege that the offensive evidence played no role in the court's decision, and its admission into evidence, even if erroneous, was, thus, of no consequence.
Notice of Appeal – A Notice of Appeal must be filed within 30 days.
Motions to Reconsider – Motions to Reconsider are commonly used to buy additional time to appeal because the 30 day period does not begin to run until the Motion to Reconsider has been completely ruled on.
Whether you are contemplating, initiating or responding to an Appeal you can call a Divorce and Family Law Lawyer at The Divorce and Family Law Offices of Wakenight & Associates, P.C. to discuss your situation for FREE and begin planning your future.
