Divorce and Paternity Cases
- Men's rights and women's rights: The implications of divorce are enormous, and you need to know what your rights are for all issues, especially financial and children's issues.
- Paternity: Non-custodial fathers and mothers have the right to be involved in their children's lives as much as possible. We help them enforce their rights when they retain the firm and we make sure our clients do not overreach when we are retained by custodial parents.
- Negotiate, mediate or collaborate: Not every case requires lengthy and costly litigation. We encourage our clients to focus on resolving their divorce or paternity matters using other methods such as negotiation and mediation.
Child-Related Issues
- Child custody and guardianship: What happens to children is often the most contentious issue in a family law case. Our lawyers help you determine the best course of action in your case. We help parents, and sometimes even non-parents, develop custody, guardianship, parenting and visitation arrangements that work for them and that are in the best interests of the children.
- Removal: The permanent removal of a child from the State of Illinois requires proving that it is in the best interests of the child. We can help you with this often difficult life changing issue.
- Orders of protection: There are both civil and criminal orders of protection. Both give police instruction as to how to act when they arrive at the scene. They also give prosecutors grounds for filing additional charges if violated.
Money Issues
- Money issues: Financial issues are often disputed, and it is important to have an attorney gather the facts about both parties' financial situation in order to resolve issues related to money.
- Alimony/spousal maintenance: There are many factors involved in calculating a fair maintenance award, including the length of the marriage and the comparative earning capacities of both parties.
- Child support: Guideline child support is set as a percentage of net income by statute. The disputes are over net income calculations. Our lawyers will ensure that your child support order reflects a fair and accurate application of the law to the facts of your case.
- Property issues: The court is obliged to divide the marital property, which includes debt allocation, "in just proportions." First we gather the facts, then we settle or the court will divide the property after a trial.
- High-asset divorce: When there are significant assets involved in a divorce, property division can become quite complex. We have the experience and knowledge to effectively handle high-asset divorce cases.
Back-to-Court Issues
Post-judgment issues — You can petition to modify those portions of your original divorce decree that pertain to children, such as child support or visitation. Property issues cannot generally be modified. We can help with modifications and enforcement as well as motions to vacate, reconsider and appeals.
All Other Issues
All other family law issues — We handle legal matters related to family emergencies, domestic violence, guardianship, grandparents' rights, multi-state litigation and all other family law matters. The scope of family law is so broad that in our view no attorney can effectively advocate in this area unless he or she does so exclusively and full time.
